1. Introduction

Welcome to Checkrider, a service provided by Alta Consulting LLC ("Company," "we," "us," or "our"). By accessing or using our website (checkrider.io) and services (collectively, "Services"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use our Services.

2. Services Provided

Checkrider connects Designated Pilot Examiners (DPEs) with pilots seeking FAA practical exams. Users can create accounts, book appointments, manage profiles, and communicate through our platform.

3. User Accounts

To use our Services, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree not to use the account, username, or password of another user at any time.

4. User Responsibilities

You agree to use our Services in accordance with all applicable laws and regulations. You must not:
  • Post malicious or harmful content.
  • Misrepresent yourself or your qualifications.
  • Engage in any fraudulent activities.

5. Intellectual Property

All content posted on our platform remains the property of Checkrider. You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display your content in connection with the Services.

6. Payment Terms

By using our Services to book an appointment with a Designated Pilot Examiner (“DPE”), you agree to the terms of our Payment Policy. Fees are charged at the time of booking and are non-refundable. You may also choose to book a backup appointment, which involves paying part of the fee upfront, with the remaining balance charged if you are promoted to the active appointment.

In the event that an examiner cancels an appointment, you may be issued a voucher in lieu of a refund, which can be applied to future bookings. The use and validity of vouchers are further outlined in our Payment Policy. We reserve the right to change the fees and payment terms at any time, with such changes becoming effective immediately.

7. Dispute Resolution

Any disputes arising out of or relating to these Terms or our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a trial by jury or to participate in a class action.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Checkrider, Alta Consulting LLC, and its affiliates, officers, directors, employees, agents, licensors, or partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Services; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Services; and/or (f) the defamatory, offensive, or illegal conduct of any third party. In no event shall Checkrider, Alta Consulting LLC, or its affiliates be liable for any claims, proceedings, liabilities, obligations, damages, losses, or costs in an amount exceeding the amount you paid to Checkrider hereunder.

9. Indemnification

You agree to defend, indemnify, and hold harmless Checkrider, Alta Consulting LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Services; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any right of privacy or intellectual property rights; (d) your violation of any law, rule, or regulation of the United States or any other country; (e) any claim or damages that arise as a result of any of your user content or any that is submitted via your account; or (f) any other party's access and use of the Services with your unique username, password, or other appropriate security code.

10. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Palm Beach County, Florida.

11. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will notify users of any changes by posting the new Terms on our website. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
